Court hears a matter seeking for temporary injunction restraining the Govt of Uganda from conducting geological activities in Hoima

East African Court of Justice, 23rd June, 2021:The First Instance Division heard an application seeking for interim orders restraining the Government of the Republic of Uganda from conducting or reviving all geological activities and evicting people of Kibiro-Hoima District and the Kingdom of Bunyoro-Kitara from their ancestral salt manufacturing lands or enacting any policy and legislation in that regard, until hearing and disposal of the main case (Reference No. 16 of 2020).

The applicant alleges that geological activities (including for geothermal energy and electricity), mining and exploration are being carried out in that area, which is the site of the Kibiro Ancient Salt Manufacturing Works that are on the Tentative List of UNESCO World Heritage Sites.

DRC President to launch EAC Verification Mission to the country

East African Community Headquarters, Arusha, Tanzania, 22nd June, 2021: The President of the Democratic Republic of Congo, H.E. Felix Tshishekedi, will on Thursday this week launch the East African Community’s verification mission to the country in the eastern Congolese town of Goma. 

A high level mission comprising EAC Secretary General Hon. Dr. Peter Mathuki and officials from EAC Organs and Partner States Ministries of EAC will witness the launch by the Congolese Head of State.

EAC Sectoral Council on Agriculture and Food Security currently underway in Arusha

East African Community Secretariat; Arusha, Tanzania; 22nd June, 2021: The 14th meeting of the EAC Sectoral Council of MinisterS on Agriculture and Food Security is currenly ongoing at the EAC Headquarters in Arusha, Tanzania and through hybrid means. 

The five-day meeting kicked off with the Session of Senior Officials on Monday, 21st June, 2021 and will run up to 23rd June, 2021 followed by the Coordination Committee Session which comprises Permanent/Principal Secretaries of Agriculture from the EAC Partner States on Thursday, 24th June, 2021. The Session of Ministers/Cabinet Secretaries has been scheduled for Friday, 25th June, 2021.

East African Community Headquarters, Arusha, Tanzania, 22nd June, 2021: The 17th Meeting of the East African Community Sectoral Council on Transport, Communication and Meteorology (TCM) is currently underway in Dar es Salaam, Tanzania.

The five-day meeting started with the Session of Senior Officials which runs from Monday, 21st to 23rd June, 2021 followed by the Sectoral Coordination Committee that brings together Permanent/Principal and Under Secretaries on Thursday, 24th June, 2021. The Sectoral Council bringing together the Ministers/Cabinet Secretaries will be held on Friday, 25th June, 2021.

Government of Zanzibar to provide land for East African Kiswahili Commission to build permanent headquarters

Zanzibar President calls for increased intra-EAC and intra-African trade

East African Community Headquarters, Arusha, Tanzania, 20th June, 2021: The President of Zanzibar, Dr. Hussein Ali Mwinyi, has called for increased trade among East African Community Partner States and by extension African countries. 

President Mwinyi said that EAC Partner States and African countries trade more with nations in other continents while trade amongst them was way too low, adding that intra-EAC and intra-continental trade was the best way to promote economic prosperity in East Africa and on the African continent.

Government of South Sudan allowed to settle Case with Litigant through Mediation as alternative dispute resolution mechanism

East African Court of Justice, 19th June, 2021: The First Instance Division has allowed the Government of the Republic of South Sudan and (Hope for Humanity Africa (HHA) that filed a case against the government to attempt settle a case through mediation as an alternative dispute resolution mechanism. 

The case by HHA is challenging the government of South Sudan on alleged oil spillage due to leakage of oil pipelines resulting to environmental pollution that affects the population. The court will fix the matter to enable the start the mediation process in two weeks’ time.

Zanzibar President roots for Foreign Direct Investment in Island's Blue Economy

East African Community Headquarters, Arusha, Tanzania, 19th June, 2021: The President of Zanzibar, Dr. Hussein Ali Mwinyi, has called for foreign direct investment from East Africa and beyond in the island’s blue economy for purposes of creating jobs for the youth.

Dr. Mwinyi said that the island was open for investment in diverse sectors of the blue economy including deep-sea fishing, ports infrastructure, marine transport, petroleum and gas, and tourism. 

“Zanzibar also requires heavy investment in modern agriculture, real estate and conference tourism,” said Dr. Mwinyi in a speech read on his behalf by the country’s 2nd Vice President, Hon. Hemed Suleiman Abdulla.

Chair of the EAC Council of Ministers calls on partner States to work together against all forms of Genocide ideology in the region

East African Community Headquarters, Arusha, Tanzania, 18th June, 2021: Kenya’s EAC Affairs and Regional Development Cabinet Secretary and Chairperson of the EAC Council of Ministers, Hon. Adan Mohamed has called upon the international community in general and the EAC Partner States in particular to work together at different levels in the fight against all forms of genocide ideology or any slightest signal of its kind. 

“If we are to succeed in eradicating the genocide vice, we need to renew our commitments now than ever before, to show those who are still enslaved in those thoughts that the world can no longer tolerate any form of divisionism in its midst and that we are united and committed,” he noted.

East African Law Society pays courtesy call on EACJ Judge President to discuss areas of cooperation with the Court

East African Court of Justice, 18th June 2021:The President of the East African Law Society Mr Bernard Ounda pays a courtesy call on the Judge President and Principal Judge of the Court to discuss areas of cooperation.

His Lordship Justice Nestor Kayobera President of the Court commended the good support so far provided to Court by EALS especially on the capacity building for the Lawyers in the Partner States on EACJ matters, publication of Law reports for the Court, survey on the implementation of the Court's decisions among others.

Justice Kayobera also called upon EALS as an Apex body which has an observer status to EAC to continue working together to implement the Treaty in particular Articles 126 on legal and judicial affairs to promote the achievements of the objectives of the Community.

"The Court cannot work without lawyers, working with lawyers does not mean interference and the independence of the Court does not mean working in isolation, we must work together for the interests of the people, so let us embrace the spirit of Teamwork" said Judge President

The Principal Judge Justice Yohane Masara, on his part, said that there is need to train lawyers on the new rules of the Court as the Court still experiences prayers from many advocates on filing of pleadings out of time as well as jurisdiction of the Court to enable them to know which cases to file to EACJ. 

EALS President Mr Bernard Oundo expressed his gratitude to EACJ for the good working cooperation with EALS and re- committed to continue the support on various areas especially on capacity building for the Judges on interpretation of Trade agreement as many cases on Common Market Protocols are increasing and Lawyers will be trained on the new rules of the Court to improve the quality of the pleadings filed to Court. 

Registrar also commended EALS for the good working relations and indicated that Court can't do without them as Key stakeholders and have filed several cases which have enriched the jurisprudence of the Court.

About the East African Court of Justice

The East African Court of Justice (EACJ or ‘the Court’), is one of the organs of the East African Community established under Article 9 of the Treaty for the Establishment of the East African Community. Established in November 2001, the Court’s major responsibility is to ensure the adherence to law in the interpretation and application of and compliance with the EAC Treaty.  

Arusha is the temporary seat of the Court until the Summit determines its permanent seat. The Court’s sub-registries are located in the respective National Courts in the Partner States.
